“We are challenging Montana’s unconstitutional TikTok ban to protect our business and the hundreds of thousands of TikTok users in Montana,” Brooke Oberwetter, a TikTok spokeswoman, said in a statement. “We believe our legal challenge will prevail based on an exceedingly strong set of precedents and facts.”
A group of TikTok users has filed a separate lawsuit claiming that the bill violates their First Amendment rights and exceeds the state’s legal authority. The law has also caused concerns among civil liberty and digital rights organisations, including the American Civil Liberties Union and the Knight First Amendment Institute at Columbia University.
Emily Flower, a spokeswoman for Montana’s attorney general, said, “We expected legal challenges and are fully prepared to defend the law that helps protect Montanans’ privacy and security.”
The bill, which comes into effect next year, aims to protect the privacy of state residents by preventing the Chinese government from accessing their personal information.
As a result, TikTok will not be allowed to operate in the state, and app stores such as Apple and Google are prohibited from making the app available for download. Daily fines of $10,000 may be imposed on TikTok, Apple, and Google for non-compliance.
