Mumbai Cricket Association polls to go ahead as scheduled on September 28 | Cricket News – Times of India

MUMBAI: The Mumbai Cricket Association (MCA) will go ahead with its elections as originally planned on September 28, it was decided at an emergent Apex Council meeting to finalise the date of the polls, on Tuesday.
“The MCA constitution mandates elections to be held before September 30. Hence, it was decided to stick to the original date of polls on September 28 (as was decided in the Apex meet on July 26),” a source in MCA told TOI.
Reacting to reports in the media that the MCA elections were likely to be postponed as the BCCI had asked the state units to delay its polls pending its appeal in the Supreme Court on the cooling-off clause, a few members of the Apex Council-treasurer Jagdish Achrekar, and members Abhay Hadap, Ajinkya Naik and Kaushik Godbole had shot off a strong letter to MCA president Vijay Patil and other Apex members about the need to have polls on the original date of September 28.
“Established in 1930, the MCA has a rich cricketing heritage with a reputation of transparent governance and administration. Hence, you are requested to ensure that the decisions of the Apex Council are held in compliance with and not in contravention of the rules and regulations of the MCA.
1)As per the MCA constitution, the Apex Council has no powers to take a decision on postponement of elections.
2)Any decision against the constitution, even if it is taken unanimously by the Apex Council, is not valid and is ultra-virus.
3)The term of the Apex Council will be over on 4th October 2022 because as per section 6(2), the term of the office-bearers is 3 years and as per section 14 (4), the term of councillors is also 3 years. Hence, technically, the Apex Council will cease to exist on 4th October 2022 and if the term is extended beyond that it will create a situation similar to 2018,” mentioned the letter.
