Can I Claim Compensation for a Delayed UK Flight?

Yes, you can claim flight delay compensation in the UK under EU regulation 261/2004. With the UK being the second worst country in Europe for flight delays, it’s not far-fetched that at some point, you’ll likely have to deal with it. No one wants to be stuck at the airport due to the incompetence of an airline but when it does happen, how can you get compensated?

What is the Flight Delay Compensation About?

The flight delay compensation is guided by the EC 261 regulation on flight disruptions. This law protects you if you arrive at your destination three or more hours later than the originally scheduled time. Under this law, you may be entitled to up to €250 – €600 in compensation in addition to other things. This includes the right to care such as access to telephone and internet connection, free meals and drinks, and a free hotel booking where necessary. 

However, to qualify for this compensation, you need to meet certain criteria. This includes:

  • Your flight is leaving from the UK or EU, regardless of the airline involved. 
  • Your flight is arriving in the UK or EU, provided that the airline is headquartered in the UK or EU. 
  • You checked in on time, which is at least 45 minutes before departure. 
  • You have a valid ticket and booking confirmation, and not a free or discounted ticket that is unavailable to the public. 

For this compensation to take effect, the reason for the delay must have been well within the airline’s control. This includes air traffic regulations, unavailability of the pilot or aircrew, mechanical and technical issues, airport staff strikes, etc. However, if the cause of the delay is due to extraordinary circumstances, the airline is not obligated to compensate you. This includes adverse weather conditions such as earthquakes or hurricanes, bird strikes, strikes outside of the airline, or a worldwide health policy mandating all airlines to stay put. 

How is the Compensation Calculated?

Each passenger is entitled to €250 – €600 and this is calculated based on the flight distance as explained below.

  • Short distance – less than 1500 km – €250
  • Medium distance – between 1500 km and 3500 km – €400
  • Long distance – above 3500 km – €600

This price is not affected by the ticket price or if it’s a child travelling. Also, you’re still entitled to individual compensation if you’re on a business trip or bought your ticket with a group. As long as you have valid booking information and also meet other criteria, you can claim compensation.
